How to Draft Form ET1 Grounds of Claim

When lodging an Employment Tribunal claim online, Box 8.2 asks for the "details of your claim". Rather than typing an emotional rant into a small text box, attach a structured, numbered Particulars of Claim document.

The Standard Legal Structure

  1. Introduction & Parties: State your job title, start date, effective date of termination (EDT), and gross/net pay.
  2. Factual Background: Chronological summary of key events leading up to the dismissal, citing dates and contemporaneous emails.
  3. Substantive Unfairness (s.98 ERA 1996): Why the employer's reason was not genuine, or why dismissal fell outside the range of reasonable responses.
  4. Procedural Unfairness & ACAS Breaches: Detail exact failures to comply with the ACAS Code of Practice (no written warning, denial of companion, bias in investigation).
  5. Remedy Sought: Financial compensation (Schedule of Loss) and request for ACAS uplift.
